REPORTED CASES INVOLVING MEMBERS OF THE COLCLOUGH FAMILY IN
THE ENGLISH AND IRISH COURTS

COLCLOUGH v MULLINER 1795. 1 Espinasse Reports P460 Nisi Prius. Stafford Assizes. The plaintiff was the owner of land let to Mulliner who encroached on common and other land of Colclough and unsuccessfully claimed squatters rights in respect of them. The report does not identify Colclough.
COLCLOUGH v GAVEN 1815. 3 Dow's Reports P267 or 3 English Reports P1062. Rev. Dudley Colclough married the daughter, Mary of Luke Gaven who by his will left property to each of his three daughters and his son William. Colclough's intervention was merely representing his wife's interests.
COLCLOUGH v BOLGER 1816. 4 Dow's Reports P54 or 3 English reports P1087 (House of Lords). This was the first of a number of cases involving the unfortunate Caesar Colclough M.P. of Tintern. His father Sir Vesey Colclough of Mocurry (i.e. Duffry Hall, Enniscorthy) born 1745, married 1765 Catherine daughter of John Grogan of Wexford was born posthumously and in 1766 inherited Duffry, Tintern &c on the death of his grandfather Sir Caesar C. But only for a life estate. He had two sons, Caesar, the plaintiff, born 1766 and John born 1767 who was noted as having died unmarried. The report says "Sir Vesey was improvident and extravagant and given to excessive dissipation". He raised money by granting leases, mortgages extending beyond the period of his life estate. In 1772 Joseph Johnson who had married one of Caesar Colcloughs daughters (i.e. Vesey's grand-aunt), applied to the court for accounts to be taken. When Vesey died in 1794 the plaintiff was a prisoner of Napoleon in France. The effect of the case generally was that Vesey's encumbrances on the estate were set aside.
COLCLOUGH v STERUM 1821. 3 Bligh's Reports, House of Lords, P186. This is a further case on facts almost identical with Colclough v Bolger but establishes the principle of law that on a sale of land by order of the court the purchaser has a duty to see that the terms of the order have been strictly observed.
(Note. Ulick Sadleir who was Deputy Ulster King of Arms in the early part of the present century had made some study of Caesar and Vesey Colclough's deplorable doings and discovered that they had just on 30 illegitimate children all of whom were given the name of Colclough - the last was named George Washington Colclough - and very adequate financial provision made out of the proceeds of his various frauds with the Tintern and Duffry estates).
SWAN v COLCLOUGH 1834. Hayes and Jones Reports P607 Patrick Colclough leased some lime and gravel workings from Graves Chamney in Kildavin and Ballychaigneau, Wexford. On his death in 1817 his son, Patrick Sarsfield Colclough (then 14 years of age) inherited the remainder of the leases and in 1826 sublet part of the land to Adam Colclough. Swan who was the personal representative of Chamney claimed damages and injunctions in respect of the waste and devastation which the Colcloughs had perpetrated on his land and evidence was given of the details of what the court described as "the extraordinary activities of the Colclough family".
COLCLOUGH v BOYSE 1857. 6 House of Lords Reports P1. 26 Law Journal Chancery Reports P256. 10 English Reports P1192 House of Lords.
BOYSE v ROSBOROUGH 1854. 3 De Gex MacNaghten and Gordon's Reports P817. These are the reports of the Colclough case which lasted for nearly 13 years and resulted in the Rosboroughs evicting Caesar Colclough's widow from the estates and upsetting his will. In the English Reports series the report of the final judgment covers some 25 large pages and in some of the others it is even more extensive. It contains a great amount of detail about Caesar's life and last days at Cheltenham.
Re COLCLOUGH 1858. 8 Irish Chancery Reports P330. Proceedings in the Encumbered Estates Court. In 1806 Patrick Colclough obtained a grant of land including Kildavin and subsequently by his will left £500 each of his grand-daughters and to his grandson Patrick Sarsfield Colclough. In 1826 Patrick Sarsfield granted a 19-year lease of the land to his father Sarsfield C. Mary Brennan was one of the grand-daughters, the other three being Julia, Margaret and Anne, wife of Nicholas Brennan. Patrick Sarsfield Colclough is described in the report as "or Adam Vesey Colclough".
COLCLOUGH v SMITH 1864. 10 Law Times reports, P918. Under a lease for life made in 1719 the interest vested in Harriet Colclough and the reversion in Thomas James Smyth. At the renewal of the lease in 1803 the last survivor was Bridget Colclough who died in that year and the property vested in Beauchamp Colclough younger son of Beauchamp Colclough of Zion Hill Carlow (aged 15 at the time of the action) in 1805 Bridget had two sons Beauchamp and Henry of Zion Hill. Beauchamp who was 9 at the time of the action and the court had to decide which was which. Beauchamp born in 1788 died in 1858 and Beauchamp born in 1794 died in 1845.
COLCLOUGH (Anne) v COLCLOUGH (Beauchamp Henry) 1870. 4 Irish Reports P263. Sarah McCarty died in 1797 and by her will left land in Dublin to her niece Bridget Colclough otherwise McCarty and part to Henry Colclough Bridget's eldest son to Beauchamp Colclough, Bridget's younger son. Bridget Colclough died intestate and unmarried. Beauchamp had nine children - John, Beauchamp Urquhart, Alexander, Henry, Guy Carleton, Marie, Bridget, Arabella and Harriet. Henry died in 1825 intestate without issue. Guy Carleton died in 1837 leaving a son Beauchamp Henry (the plaintiff). John died in 1849 without issue leaving an estate whereby all his estate passed to his wife Anne. The other sons were all dead by 1870. Marie died in 1830 intestate without issue. Alexander and Arabella both died under age without issue. Beauchamp died in 1847 having made a will.
In the Goods of COLCLOUGH 1992. 2 Irish Reports P499 George Bolton Colclough died intestate 25 Feb. 1890, widower, leaving surviving children Fanny, George Bolton Jnr., Sarah (wife of James Usher), Ellen, Charles, James, Nanny and Henry. His assets consisted of a farmhouse know as Barna, Kilkenny, farming stock and personal estate to a gross value of £208. On 25 March 1890 letters of administration were granted to his son George Bolton C. who merely paid some debts and funeral and administration expenses and on 31 July 1900 emigrated to Victorian, Australia, his address being unknown, leaving the residue unadministered. The grant was revoked and administration de bonis non made to Henry Colclough.
In the goods of JOHN COLCLOUGH. 19 Law Reports Ireland P235. Probate, April 29 1887. John olclough died 2nd October 1853 seised, with other considerable property, of the lands of Finnstown, Dublin and by will dated 23 Jan. 1853 left to his wife Catherine for life with remainder to his children the whole of his estate. He left 8 children of whom one was Constantine who died intestate 2 April 1883 and whose share was later vested in Thomas, another of the children who later assigned it to William Lynam and Bernard Gerrard as trustees for Mary Colclough, Henry Vesey Colclough obtained administration to John Colclough be bonis non on 8 July 1883. Catherine and Mary two others of the children died and the property became vested in the other six. Henry Vesey Colclough sailed for America on 13 October 1883 and is not expected to return to Ireland and assigned to his sister Mary Spain (formerly Colclough) his share of Finnstown. Letters of Administration granted to Brady and Lynam. (Reference was made to a case of Lynam v Colclough in the judgment but I have not found a report of this).
COLCLOUGH V EDWARDS 1893 57 J.P. Journal P772. Divisional Court Colclough (not further identified) was the superintendent of a Salvation Army night hostel and was convicted under the Public Health (London) act of having failed to ensure that accommodation occupied by a person suffering from an infectious disease had been disinfected. The conviction was quashed on the ground that the hostel did not come within the Act. The headnote to the report says "Admitting entrants to a night shelter at 1d per head is not letting for hire".
HAWKINS v COLCLOUGH 1757 1 Burrow's Reports 275. 2 Kenyon K.B. 553 "An arbitrator is presumed to have dealt with the subject - matter of the reference and the burden of proof lies on the party denying it". Hawkins having sued John Colclough for assault, battery and false imprisonment the parties agreed to leave the assessment of damages to arbitration. The arbitrator appointed, who was a cobbler, put the damages at 5/-. The Chancery Court on 5 May 1757 upheld this award on the grounds that the cobbler was a simple man who had dealt with the matter honestly according to his own limited understanding and that as Hawkins had agreed to his appointment in the first place he could not subsequently object on getting the award.
R.v. COLCLOUGH 215 Cox Criminal Cases P92. Court of Crown Cases Reserved "Evidence that the accused on other occasions had in his possession other forged instruments is admissible to prove that he know the instrument to be forged". Colclough (not identified) was stamp receiver of Queens Bench Court in Dublin and had to issue printed forms bearing revenue stamps impressed in the stamping offices and brought to his by a messenger to when he gave the appropriate payment. From time to time two forms would inadvertently be stamped together and only one payment charged. He was convicted of uttering a forgery for handing out one of these 'blinds' as they were called and the conviction was upheld on appeal.
R.v. COLCLOUGH 1909 73 J.P.Journal P147. 2 Crim. Appeal Reports 147 "Court of Criminal Appeal has no power to order a new trial." William Samuel Colclough was indicted for indecent assault at Staffordshire Assizes and on 19. Feb. 1909 was sentenced to 12 months hard labour. On further evidence becoming available, that of a solicitors clerk who had passed the spot where the alleged assault took place immediately afterwards and had seen the accused and the complainant there and that the girl did not appear to be distressed and made no appeal for help, Mr Justice Darling held that he could not order a new trial but reduced the sentence from 12 months to six.
VICARS v COLCLOUGH 1779. 5 Brown's Parliament Cases P31 Sequestrators may not follow property into the hands of a purchaser without notice". House of Lords. 30 April 1779. Timothy Colclough was the executor of Thady Carrol. Carrols father had bought property in Queens Country but had been displaced from this as a result of the perjured statements of Richard Vicars that he was Baptist in 1723, and he died in 1770 "worn out by 20 years of litigation's". Vicars made a further unsuccessful attempt to acquire the property.
COLCLOUGH v COLCLOUGH & FISHER 1933 Probage 143 49 Times Reports 434 "In varying a marriage settlement after a divorce the court must be concerned primarily with the interests of the children but powers conferred by the settlement on an innocent spouse are not curtailed". Rev. Colclough (? son of Admiral Beauchamp Urguhart Colclough) then aged 28, had divorced his wife Betty then aged 22, there being one child of the marriage. The proceedings were concerned with the disposal of a marriage-settlement of some £50,000.

The Court Rolls of the Manor of Tunstall from 1348 to 1719 with a gap from 1378 to 1512 have been preserved and transcripts of them were published by the North Staffordshire Field Club from 1920 onwards in their "Transactions" , vols. LIX to LXVII. Members of the Colclough family appear in these continuously as residents in Olcott (Owlcote) , Breerhurst , Burslem , Chell , Tunstall itself and thereabouts. Most of the records are purely formal recording their presence or absence from the Court either by leave (essoins) or in default and their membership of Inquests for the King , the Great Inquest , Inquest of Office &c , their being amerced for minor infringements of the privileges of the Lord of the Manor in respect of brewing or baking , or transferring land without leave. The records are interesting chiefly in associating names with particular localities at precise points of time.
